Delaware legislators proposed an 80 page bill that does much more than its supporters claim.
The sponsor describes it as a simple update. SB 250 would in fact fundamentally alter the relationship between children and their biological parents, robbing children of their right to know their biological history.
It also has many other unintended consequences that could legalize activity that is currently considered criminal for the protection of children.

We are concerned Delawareans that are urging you to oppose Senate Bill 250.
While SB 250 is presented as an update to Delaware’s Uniform Parentage Act, it represents a significant expansion of legal frameworks surrounding assisted reproduction and surrogacy, including provisions related to donor conception, contractual parentage, and the recognition of non-biological parental claims.
These changes are not minor technical adjustments. They reshape how our state defines parenthood, family, and the rights of children.
Our Concerns
- Children Risk Being Treated as Contractual Outcomes
SB 250 further embeds a system in which children may be brought into the world through legal agreements and financial arrangements, rather than being recognized first and foremost as human beings with inherent dignity.
We believe the law should treat children as persons to be protected—not products to be negotiated.
2. Expansion of Commercialized Reproduction Without Adequate Safeguards
The bill updates and expands provisions related to surrogacy and assisted reproduction, including recognition of various types of carrier agreements.
This raises serious ethical concerns about:
- The potential commercialization of women’s bodies
- Financial incentives influencing reproductive decisions
- Insufficient long-term protections for children born through these arrangements
- Redefinition of Parenthood Away from Biological Reality
SB 250 continues a shift toward defining parenthood through intent, contract, or function, rather than biological connection.
While legal clarity is important, removing the centrality of biological parenthood risks:
- Creating identity challenges for children
- Weakening the natural parent-child bond
- Introducing legal complexity and future disputes
- Long-Term Consequences Have Not Been Fully Vetted
This legislation is extensive and far-reaching. Changes to parentage law affect:
- Family courts
- Inheritance rights
- Custody disputes
- The lifelong well-being of children
We respectfully ask you to Vote NO on SB 250. Delaware’s laws should uphold this clear and consistent standard:
Children are not commodities. They are human beings with inherent dignity, deserving of protection, identity, and stability.

It is presented as a simple update to our parentage laws. But it is built on the foundation of rejecting biological reality and the sanctity of the family – starting with removing the terms “mother” and “father.”
This worldview has real implications – particularly for children.
For example – the background checks required in adoption situations are ignored in cases of surrogacy and artificial reproduction in SB 250.
This means that what is currently considered illegal “baby selling” could be legalized under SB 250!
This is an example of the harm that comes from adult desires being prioritized over children’s protection.
