Parental Consent for Abortion Not Required in DE?? 😮

Currently in Delaware, parental consent is required for many things – but not for abortion.

HB 46 would have removed a major infringement on parental rights by requiring parental consent for abortion. This is one step closer to protecting minors, and preborn babies.

HB 46 failed in committee in March of 2025.

Talking Points to Send to your Legislator

Vote Yes on HB 46!

  • Parental consent is required for decisions much less weighty than abortion.
  • Parents are best equipped to care for and protect their children. HB 46 already accounts for the few who are not.
  • The state has a compelling interest to protect a parent’s God-given right to the care and custody of their children.

Please release HB 46 from committee.

Read the bill and see the sponsors here.

In Delaware, a minor can get an abortion without parental consent; a parent simply has to be notified 24 hours before the abortion.

Abortion is a life-altering action. Minors are required to get parental consent for much less serious decisions; it only makes sense that abortion should require parental consent.

Children should never be in situations to make decisions without the love, care, experience, knowledge, and especially consent of their parents in the increasingly dangerous world around us.

HB 46 is a step in the right direction of recognizing the seriousness of abortion, and a parent’s God-given right to the care, custody, and control of their children.

House Bill 46 will be heard in the House Health and Human Development Committee on Wednesday, March 26th, at 11:30am.
