Talking Points for SB 5 and HB 14

1. It is a fundamental violation of human rights to place “reproductive freedom” above human life.

  • It is morally wrong and fundamentally un-American to deny an entire class of human beings – the preborn – the right to life.
  • Protecting adults’ desire to have sex without responsibility, at the expense of the children who are created from that act, has no place in our Constitution!
  • Abortion is already legal in Delaware. SB 5 and HB 14 go further, and guarantee that Delaware’s preborn will have zero rights in Delaware, permanently. 
 

2. Abortion is NOT healthcare! The entire process is contrary to what true healthcare looks like.

  • Dismembering a child is not healthcare. 
  • Lethally injecting a child in the brain is not healthcare.
  • Purposefully stopping a child’s heart is not healthcare.
 

3. SB 5 has no age limits – it gives limitless “reproductive freedom” to children!

  • Does SB 5 allow children to get an abortion without parental notification?
  • Does SB 5 – which includes “sterilization” – allow children to transition their gender without parental consent, as a fundamental constitutional right?

4. HB 14’s “right to privacy” would make abortion on demand a Constitutional right.

  • The “right to privacy” is the language used in Roe v. Wade to codify abortion on demand. Killing the preborn is not a right!

In 2017, virtually limitless abortion was legalized in Delaware. Since then, the legislature has made it clear that abortion is the priority of their agenda. Legislators have passed bills to allow nurses and APRNs to practice surgical and chemical abortions, forced DE taxpayers to fund abortions, and forced colleges to provide abortions on campus, among other policies. Legislators have also refused to pass a bill that would require abortion doctors to offer women the option of seeing their ultrasound, or restrict abortion after 20 weeks, well after the point when preborn babies can feel pain.
 
Despite abortion already being legal and funded in Delaware, legislators proposed not one, but two bills in 2025 to enshrine abortion into the Delaware State Constitution.
 
The first Constitutional Amendment – Senate Bill 5 – passed the Senate and will be heard next in a House Committee.
 
The second Constitutional Amendment – House Bill 14 – is slightly more subtle; it would enshrine the right to privacy in the Delaware Constitution. However, this language is what the US Supreme Court used to justify Roe v. Wade, even without an explicit “right to privacy” in the US Constitution. HB 14 passed the House Administration Committee and will be heard next on the House Floor.

When does life Begin?

Viability is an arbitrary standard for determining which preborn babies deserve the right to life. Basic embryology shows that human life begins at conception. And a basic understanding of human rights demands that all human beings have the right to life.

How is an abortion performed?

Is abortion ever medically necessary?

Abortion is the intentional killing, by lethal injection or dismemberment, of a preborn baby. It is not the same as delivering a baby early, or removing the body of a baby that has already tragically died from miscarriage.

Government's role is to protect life -particularly for those who cannot defend themselves.

The Declaration of Independence says that the role of government is to "secure" the inalienable rights given to each of us by our Creator - including the right to life.

In fact, the Bible has strong words for those who fail to protect life: "Rescue those who are being taken away to death; hold back those who are stumbling to the slaughter. If you say, 'Behold, we did not know this,' does not he who weighs the heart perceive it? Does not he who keeps watch over your soul know it, and will he not repay man according to his work? Proverbs 24:11-12
