1) There are many institutions built on the need to know a person’s biological sex:
- Medical settings, especially in emergency situations;
- Law enforcement;
- General data collection;
- Financial institutions for the purpose of preventing identity fraud;
among others.
It would create chaos to allow individuals to change their gender on their legal documents, for any reason, for an unlimited amount of time, with virtually no access to the original document.
2) HB 375 allows parents to change their gender designation on their child’s birth certificate. This could deprive children the right to know the full truth about their parents.
HB 375 undercuts transparency by allowing individuals to keep their biological gender as classified information.
Policy should be rooted in objective reality, not subjective feeling. HB 375 is extremely problematic; please vote NO!

HB 375 allows Delaware adults to change their sex designation on their birth certificates, marriage record, and drivers license, without requiring a court order or supporting documentation in many circumstances.
Furthermore, HB 375, allows the original records to be sealed in permanently confidential files, creating additional red tape for outside entities and states who would need to access those files.
HB 375 weakens the integrity of government records, creating an administrative nightmare.
Government documents are meant to provide an accurate record of a person’s identification. If a major aspect of a person’s identity – their sex – is a lie on their government documents, this has implications for
- public safety,
- law enforcement,
- medical settings,
- data collection,
- interstate cooperation,
- accuracy of data in parental custody disputes,and
- legal identification purposes.
Lowering the standards for verifying a person’s identity undermines trust in state records, weakens transparency, and creates administrative chaos.
Why It Matters
HB 375 moves Delaware further away from truth-based government records and toward ideology-driven identity policies.
Public records should reflect objective reality — not subjective self-identification that can change over time.
Delaware needs to protect truth, transparency, public accountability, and the objective accuracy of state identification documents — especially when children and legal records are involved.
Policy should be grounded in reality, not the changing whims of fickle feelings. Rejecting common sense creates chaos, and HB 375 is a prime example of this.
HB 375 was released from the House Health and Human Development Committee on May 6th and sent to the House Appropriations Committee.
